Second hospitality sector class action lawsuit

As part of the filed class action lawsuit, the Law Firm represents entrepreneurs from the hospitality sector in proceedings against the State Treasury for a determination of liability for damage caused by unlawful actions and/or omissions in the exercise of public authority, in connection with the introduction of restrictions, obligations and prohibitions pursuant to regulations of the Council of Ministers during the COVID-19
epidemic, as well as the failure to introduce a state of emergency – a state of natural disaster.

The group consists of entrepreneurs who, in the period from 24 October 2020 to 27 May 2021, conducted business activity involving the preparation and serving of food and beverages to guests seated at tables or selecting dishes from a displayed menu for on-site consumption and/or business activity related to the consumption and serving of beverages, and who suffered damage as a result of the aforementioned restrictions.

In the present case, bearing reference number II C 7/24, a final decision has been issued by the Regional Court in Warsaw to examine the case in group proceedings. This decision has opened the way for further substantive proceedings and the issuance of a judgment.

We hereby inform that, by decision of 8 April 2026, the Court ordered the publication of a notice on the commencement of the group proceedings.
